Brief Description

In 2018, the Central Islamic Council of Thailand issued the Regulation on the Marriage (Nikah) of Persons Under 17 Years of Age B.E. 2561, which came into effect on November 29, 2018. The regulation establishes that all proposed marriages involving individuals under the age of 17 must be reviewed by the relevant Provincial Islamic Committee or mosque-level Islamic Committee. Exceptions may be granted in cases of necessity, but require court certification, the Justice Dato’s approval, or written parental consent. The regulation also requires the formation of a sub-committee to consider rights and protections under Islamic law, including at least one female member with expertise in Islamic teachings, especially for cases involving female petitioners.
